Acceptance of Terms of Service

Welcome to Fishkind & Associates, Inc.

The Fishkind & Associates, Inc website is currently provided free of charge with the exception of our PowerPoint Presentations, which are provided free of charge to our seminar attendee's, and Economic Forecast Subscription area, which is accessible through the purchase of an annual Subscription.

These Terms of Service will govern your use of Fishkind & Associates Economic Forecast Subscription area. By using the information within the Subscription area you indicate your agreement to be bound by these Terms of Service, and as such, terms may be modified from time to time. If you do not agree to these Terms of Service, please do not purchase an annual Economic Forecast Subscription.

Economic Forecast Subscription

The user understands and agrees that the purchase of an annual Economic Forecast Subscription provides them with access to specific content. Due to the fluid nature of the content provided, information will be updated, added to, or deleted over time.

Economic Forecast Subscriptions automatically expire one year from the Subscription start date. An automated email reminder will be sent out a week prior to expiration to the email account of record at which time you may or may not elect to manually renew your Subscription.

Economic Forecast Subscription Registration Information

Fishkind & Associates, Inc employs a secure third-party subscription management system provided by Authorize.Net. You will be required to provide your name, e-mail address, and credit card information to Authorize.Net in order to purchase an annual Forecast Subscription. The Subscription charges will appear on your credit card bill under our name, Fishkind & Associates, Inc. Fishkind & Associates, Inc reserves the right to change its Subscription fees at any time.

Termination

Fishkind & Associates, Inc reserves the right, at its sole discretion, to immediately, without notice, suspend or terminate your Economic Forecast Subscription upon any breach by you of our Terms of Service.

Economic Forecast Subscription Username and Password

You are solely responsible for maintaining the confidentiality of your username and password. Your Economic Forecast Subscription username and password may not be posted to any publicly viewed area, and or web page, and may not be shared between classmates and friends. Access to the Subscription area may be shared within the context of a company Subscription, however, the registered Subscriber shall be responsible for all uses of their registration, whether authorized or not. You agree to immediately notify Fishkind & Associates, Inc of any unauthorized use of your Subscription or password.

Use of Economic Forecast Subscription Information

You expressly agree that the content within the Fishkind & Associates, Inc Economic Forecast area is solely for your personal and or company use, and all content provided on the website is the property of Fishkind & Associates, Inc. Forecast subscribers may download information for their personal use, and or to utilize within 3rd party reports, only with appropriate attribution. No raw data in the Subscription area may be posted in any public, and or privately viewed shared area, without the written consent of Fishkind & Associates, Inc.

Economic Forecast Subscription Refunds

Fishkind & Associates, Inc treats Economic Forecast Subscriptions as content memberships, and as such, once the Subscription area is accessed the presumption is that the Subscriber has utilized our services and or content, and they forfeit all rights to a refund.

Prior to registration potential Subscribers are required to review the Example of Services and Software & System Requirements information pages to determine Subscription suitability. By agreeing to our Terms of Service it is understood that you have reviewed this information and determined that you have (a) the necessary software/system requirements, and (b) our Subscription area content will meet your requirements.

Subscriptions may be canceled at any time, however, we offer an unlimited-use Subscription, which may be used as often or as little as the Subscriber wishes during the Subscription period, therefore we do not provide a prorated refund.

Disclaimer of Warranties

Fishkind & Associates, Inc makes no warranty that our services and or content will meet your requirements, or that our services will be uninterrupted, timely, secure, or error free.

Nor does Fishkind & Associates, Inc make any warranty as to the results that may be obtained from the use of content within the Subscription area.

You understand and agree that Fishkind & Associates, Inc will not be liable for any direct, consequential or incidental damages, whether foreseeable or not, which may result from the information provided by Fishkind & Associates, Inc.

You understand and agree that Fishkind & Associates, Inc does not guarantee the accuracy or completeness of any information in or provided in connection with the Subscription area, nor are we responsible for any errors or omissions or for the results obtained from the use of such information.

Limitation of Liability

Fishkind & Associates, Inc shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use of or the inability to use Fishkind & Associates, Inc or for the cost of procurement of substitute services.

Applicable Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida. By subscribing to or entering the Fishkind & Associates, Inc website you consent and submit to the exclusive jurisdiction and venue of the state and federal courts located in Florida.

Remedies for Breach of these Terms by You

In the event that Fishkind & Associates, Inc determines, in its sole discretion, that you have breached any portion of these Terms of Service, Fishkind & Associates, Inc reserves the right to (1) warn you via e-mail that you have violated these Terms of Service, (2) discontinue or terminate your Economic Forecast Subscription.

Miscellaneous

In the event that any provision of the Terms of Service conflicts with the law under which the Terms of Service are to be construed or if any such provisions are held invalid by a court with jurisdiction over the parties to the Terms of Service, such provision will be deemed to be restated to reflect as nearly as possible the original intentions of the parties in accordance with applicable law, and the remainder of these Terms of Service will remain in full force and effect.
